These new fees will go into effect <strong>April 1, 2024<\/strong> and are applicable to all petitions received by USCIS on or after that date. You can read the full rule <a href=\"https:\/\/public-inspection.federalregister.gov\/2024-01427.pdf\" target=\"_blank\"><span class=\"sqsrte-text-color--lightAccent\">HERE<\/span><\/a>.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">As you may recall from the draft rule released in January 2023, the agency proposed to: (1) increase the base fees for all immigrant and nonimmigrant petitions, (2) impose additional fees for H-2A and H-2B named petitions (i.e., for transfers and extensions), and (3) require petitioning employers to pay a mandatory fee to help fund the agency\u2019s humanitarian asylum program.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\"><span class=\"sqsrte-text-highlight\" data-text-attribute-id=\"83f1812f-4c0d-4490-a9ce-4be1bbf0e47c\"><strong>Fee Amounts<\/strong><\/span><\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">In general, the Final Rule released yesterday adopts all major provisions of the proposed rule. Currently, filing with Premium Processing guarantees \u201cfirst action\u201d on your petition within 15 calendar days. The Final Rule modifies this standard to 15 business days. This may result in a minor delay in petition approval.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\"><span class=\"sqsrte-text-highlight\" data-text-attribute-id=\"22d535ae-c7e1-4155-a453-c485477e7dd4\"><strong>Limitations on Named Petitions<\/strong><\/span><\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">In addition to the fee increases, the Final Rule caps the number of workers that may be included on a single named petition to <span class=\"sqsrte-text-highlight\" data-text-attribute-id=\"61c3ae0d-b54b-4da3-a499-0f8c934d3ca2\">25 workers<\/span>.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">In practice, this means that employers transferring or extending the status of large groups of workers will need to file separate petitions (and pay all associated fees) for each increment of 25 workers. <\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\"><span class=\"sqsrte-text-highlight\" data-text-attribute-id=\"7099c366-2663-46aa-87ca-622d73130920\"><strong>Conclusion<\/strong><\/span><\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">We share in your disappointment that USCIS has decided to dramatically increase the program participation costs for H-2A and H-2B employers, particularly on the heels of increasing wage rates and other employer-unfriendly program changes. We also understand that the new fee framework may be confusing, given the high degree of variability depending on petition type and employer circumstances. <\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Over the next several days, m\u00e1sLabor will conducting a comprehensive analysis on the Final Rule\u2019s impact.
