{"id":868,"date":"2023-09-12T14:50:00","date_gmt":"2023-09-12T14:50:00","guid":{"rendered":"https:\/\/maslabor.criticaldev.site\/2023\/09\/12\/notice-gtgt-occupational-employment-and-wage-statistics-oews-wage-rates\/"},"modified":"2026-03-13T13:30:56","modified_gmt":"2026-03-13T13:30:56","slug":"notice-gtgt-occupational-employment-and-wage-statistics-oews-wage-rates","status":"publish","type":"post","link":"https:\/\/maslabor.com\/es\/2023\/09\/12\/notice-gtgt-occupational-employment-and-wage-statistics-oews-wage-rates\/","title":{"rendered":"Notice: Occupational Employment and Wage Statistics (OEWS) Wage Rates"},"content":{"rendered":"<div class=\"sqs-html-content\">\n<p class=\"sqsrte-large\" style=\"white-space:pre-wrap;\"><span class=\"sqsrte-text-color--lightAccent\"><strong>The vast majority of H-2A applications are not subject to this wage methodology<\/strong><\/span><\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">As previously communicated, on June 16, 2023, the Department of Labor&#8217;s Employment and Training Administration (ETA) <a href=\"https:\/\/www.federalregister.gov\/documents\/2023\/06\/16\/2023-12896\/labor-certification-process-for-the-temporary-employment-of-foreign-workers-in-agriculture-in-the\" target=\"_blank\"><span class=\"sqsrte-text-color--black\">published a federal register notice<\/span><\/a> updating the Adverse Effect Wage Rates (AEWRs) governing all occupational classifications aside from the six noted below, which remain subject to the standard state-by-state AEWR methodology.<\/p>\n<ul data-rte-list=\"default\">\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\">45-2041 \u2013 Graders and Sorters, Agricultural Products<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\">45-2091 \u2013 Agricultural Equipment Operators<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\">45-2092 \u2013 Farmworkers (Crop, Nursery, and Greenhouse)<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\">45-2093 \u2013 Farmworkers (Farm, Ranch, and Aquaculture Animals)<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\">53-7064 \u2013 Packers and Packagers, Hand<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\">45-2099 \u2013 Agricultural Workers, Other<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" style=\"white-space:pre-wrap;\"><span class=\"sqsrte-text-color--lightAccent\"><strong>Other job classifications<\/strong> <\/span><\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">DOL will annually adjust and set the hourly AEWR based on the statewide annual average gross wage, as reported by the <a href=\"https:\/\/www.bls.gov\/oes\/\" target=\"_blank\"><span class=\"sqsrte-text-color--black\">Occupational Employment Statistics<\/span><\/a> (OES) surveys. Examples include, but are not limited to, heavy tractor-trailer truck drivers, supervisors, farm mechanics, and agricultural construction workers. The updated wages went into effect on July 1, 2023, and are published on the DOL website. While the updated wages are available DOL\u2019s website, we recognize that the website can be hard to navigate. We have prepared a <a href=\"https:\/\/acrobat.adobe.com\/link\/review?uri=urn%3Aaaid%3Ascds%3AUS%3A52c5fb23-8de2-3509-8e9d-f25bbddd280c\" target=\"_blank\"><span class=\"sqsrte-text-color--black\">wage chart<\/span><\/a><span class=\"sqsrte-text-color--black\"> <\/span>for your convenience that includes the most common occupations that were issued a primary or secondary SOC code subject to OEWS wages.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\"><span class=\"sqsrte-text-color--lightAccent\"><strong>Who\u2019s impacted<\/strong>?<\/span><\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Numerous legal challenges have been filed around the country seeking to enjoin the AEWR rule. However, to date, none of those have come to fruition and therefore the existing wage methodology applies for the time being.&nbsp;Bear in mind, these wages apply only if your application was filed on or after March 30, 2023 (start dates on or after June 13, 2023), AND you were certified with a hybrid and\/or non-standard occupational classification aside from those listed above. In practice, this means the vast majority of <a href=\"https:\/\/maslabor.com\/es\/h2a\/\">H-2A applications<\/a> are not subject to this wage methodology.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Although this affects only a minority of current H-2A applications, please do not hesitate to reach out to your Case Manager to confirm any potential applicability based on your occupational assignment relative to the effective date of this new rule.
