Lawful Permanent Residency

Lawful permanent residency (also known as “Green Card” status) allows foreign individuals to live and work in the U.S., without restriction, for an indefinite period.

For most employment-based Green Cards, the foreign individual must be sponsored by a U.S. employer offering full-time, year-round employment. In most cases, the sponsoring employer must obtain a Permanent Labor Certification through the U.S. Department of Labor’s PERM Program prior to filing an immigrant petition.

Immigrant visas are allocated based on country of origin and “preference category” (EB-1, EB-2, EB-3, etc.), assigned based on the nature of the job opportunity, its requirements/skill level, and the individual worker’s qualifications (education, work experience, etc.).

Green Card sponsorship is a multi-stage, multi-year process, generally taking a minimum of three (3) years. Actual processing time varies by country and preference category.
