H-2A Worker Pay Statements: Non-Compliance can be Costly

Compliance is the most difficult part of the entire H-2A process. One area clients often risk becoming non-compliant is in their pay statements.

What are the pay compliance requirements?

The regulations require employers to furnish to workers, on or before each payday, one or more written statements containing the following information:

  1. Rate of pay (hourly and/or piece rate);

  2. Number of piece units earned each day, if applicable;

  3. Total hours worked in the pay period;

  4. Total hours offered in the pay period;

  5. Gross earnings;

  6. Amount and reason for any deductions;

  7. Net earnings;

  8. Beginning and ending dates of the pay period; and

  9. Employer's name, address, and FEIN

Simple mistakes and missing information can be costly.
