When it comes to H-2A, in recent years, increased enforcement efforts by State and Federal governments have left many H-2A users vulnerable to fines and penalties.

It’s essential - now more than ever - that H-2A employers be diligent in maintaining their compliance. One area that many find difficult is the U.S. Recruitment portion of the process.

What to remember to maintain compliance

✅ Offer re-employment to eligible former U.S. employees employed in the last year.

✅ Offer U.S. hires employment no later than the contract start date and guarantee earnings for first work week.

✅ Extend corresponding U.S. workers to at least the same terms and conditions as the H-2A workers.

✅ Provide all H-2A and U.S. workers with a copy of the contract.

Non-compliance isn’t worth the risk.
