Answer: This depends on a few variable factors, including enrollment date relative to the requested start date, government processing timing, and consular availability in your country of origin.

Typically, we can file your H-2A application no earlier than 75 days from your requested start date. For employers using the H-2A program for the first time, the regulations allow for an emergency filing as late as 45 days from your start date. However, that comes with an increased likelihood of late approval issuance. To maximize your chances of getting the right workers, it’s essential to enroll timely and provide your Case Manager with all the necessary information to file at the earliest allowable date.
