Common Questions from New H-2A Employers: Driving Arrangements for Workers?
Answer: Workers can get a valid driver’s license for the duration of the contract. We would need to ensure they have a license in their home country to be eligible for a license when they arrive. Driving other workers is considered a compensable time and may require a wage higher than the Adverse Effect Wage Rate (AEWR), depending on your state. Many clients will arrange and coordinate for their workers to get driver’s licenses during the first few weeks in the country, which is something másLabor can advise on.
Note: The Adverse Effect Wage Rate is the wage below which there would be an adverse effect on the wages of U.S. workers. Read more here for additional background from the Department of Labor, or get in touch with másLabor to discuss.
